Legal Theory

Main article: Feminist legal theory

The study of feminist legal theory is a school thought based on the feminist view that law's treatment of women in relation to men has not been equal or fair. The goals of feminist legal theory as defined by leading theorist Claire Dalton, consist of understanding and exploring the female experience, figuring out if law and institutions oppose females, and figuring out what changes can be committed to. This is to be accomplished through studying the connections between the law and gender as well as applying feminist analysis to concrete areas of law.

Won’t this whole instinct matter bear revision?
Won’t almost any theory bear revision?
To err is human, not to, animal.
    Robert Frost (1874–1963)

I am opposed to writing about the private lives of living authors and psychoanalyzing them while they are alive. Criticism is getting all mixed up with a combination of the Junior F.B.I.- men, discards from Freud and Jung and a sort of Columnist peep- hole and missing laundry list school.... Every young English professor sees gold in them dirty sheets now. Imagine what they can do with the soiled sheets of four legal beds by the same writer and you can see why their tongues are slavering.
    Ernest Hemingway (1899–1961)
