Court of Appeals Decision
The Court of Appeals' Third Division voted 3-2 to deny Webb's motion for reconsideration and upheld the ruling of Judge Tolentino on December 16, 2005.
The court ruled that the ParaƱaque RTC was correct in sentencing Webb et. al. due to "overwhelming evidence that showed Webb and the other accused had conspired to rape Carmela and, in the process, kill her and the rest of the family." The court also amended the award of damages from 100,000 pesos to 200,000 pesos, and also upheld the conviction of Biong as accessory to the crime "by abusing his public functions... to conceal and destroy the physical evidence in order to prevent the discovery of the crime and by allowing the destruction of the physical evidence, Biong facilitated the escape of the principal accused."

Famous quotes containing the words court, appeals and/or decision:
“Of all things in life, Mrs. Lee held this kind of court-service in contempt, for she was something more than republicana little communistic at heart, and her only serious complaint of the President and his wife was that they undertook to have a court and to ape monarchy. She had no notion of admitting social superiority in any one, President or Prince, and to be suddenly converted into a lady-in-waiting to a small German Grand-Duchess, was a terrible blow.”
—Henry Brooks Adams (18381918)
“We tried pathetic appeals to the wandering waiters, who told us they are coming, Sir in a soothing toneand we tried stern remonstrance, & they then said they are coming, Sir in a more injured tone; & after all such appeals they retired into their dens, and hid themselves behind sideboards and dish-covers, still the chops came not. We agreed that of all virtues a waiter can display, that of a retiring disposition is quite the least desirable.”
—Lewis Carroll [Charles Lutwidge Dodgson] (18321898)
“How could a man be satisfied with a decision between such alternatives and under such circumstances? No more than he can be satisfied with his hat, which hes chosen from among such shapes as the resources of the age offer him, wearing it at best with a resignation which is chiefly supported by comparison.”
—George Eliot [Mary Ann (or Marian)
